OFFICIAL CONTEST RULES AND REGULATIONS SPC+ Ultimate Party Contest The Contest starts on July 1st, 2022 at 12:00 AM EST and ends on July 31st, 2022 at 11:59 PM EST (the “Overall Contest Period”). By participating in the Contest, each entrant agrees to abide by and be bound by these Official Contest Rules. Entrants further agree to abide by and be bound by all decisions of the Student Price Card Ltd. (“SPC”, or the “Sponsor”), which shall be final and binding, without right of appeal, in all matters relating to this Contest and the awarding of the prize, including without limitation eligibility and/or disqualification of entries. 
 Limit one (1) entry per person, regardless of method of entry. PRIZES There are two (2) prize packs available to be won: and each referred to as “ultimate party” and consisting of the following... A $500 pizza Gift card - Exact Pizza place to be discussed once winner is chosen- based on location. SPC+ branded decor and materials. Specifics and quantities to be determined at a later date in coordination with the prize winner. A 2-hour food catering service from a vendor of SPC’s choosing. To be determined at a later date in coordination with the prize winner and location. The parameters of the prize winners’ ultimate party are to be discussed between SPC and the prize winner upon confirmation. [NOTE: is each prize package what is referred to as “ultimate party”? If so, I would define it as such and have made a suggested change in that regard] By accepting the prize, the prize winner consents to hosting their ultimate party at a location of their choice, which they have full authority to do so,[NOTE: this is not clear – do you mean that the winner is to confirm that they have authority to host the event at the particular location?] by August 31st, 2022. By accepting the prize, the prize winner consents to allowing SPC to record and take photos of the party, including party attendees [NOTE: what about consents from party attendees?]. Releases for photos will be provided for signing the day of the event. The approximate retail value of each prize is approximately $4,000.00. This prize is not cash transferable, cannot be altered or changed. Must be awarded as is. ELIGIBILITY This Contest is only open to legal residents of Canada who are over the age of 14 at the time of entry. Entrants below the age of majority in their jurisdiction of residence must have permission from their parent or legal guardian in order to enter. Excluded from eligibility are the officers, directors, employees, assigns, agents and representatives of Sponsor, the Canadian Imperial Bank of Commerce (“CIBC”) any Contest judges, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies (collectively, the "Contest Parties"), and members of the immediate families (defined as parents, siblings, children and spouses, regardless of where they live) or households (whether or not related) of such officers, directors, employees, agents and representatives. HOW TO ENTER In order to be eligible for contest entry, SPC+ members must participate through the contest link within the overall contest period. In order to become an SPC+ member, users must register for a SPC+ membership by following the link https://www.spccard.ca/cibc and following the steps to register for SPC+. NO PURCHASE NECESSARY To enter the Contest without being an SPC+ Member: Email your Full Name, Age, Street Address and Unit Number, City, Province, Postal Code, Daytime Telephone Number including Area Code, and a 300 word essay on why one believes they deserve to win to contests@spccard.ca with the subject line, “SPC+ Cool Kid on The Block Contest”. Limit one email-in entry per person. All email in entries must be received no later than July 31st, 2022 at 11:59 PM EST. WINNER SELECTION  On August 1st, 2022 at 10:00 AM EST, two (2) potential winners will be drawn at 999 Edgeley Blvd Unit 1, Concord, ON L4K 5Z4. Sponsor will randomly select two (2) potential winners from all eligible entries. If your entry has been selected as potentially eligible to win a Prize, you will be notified by email. Up to two (2) attempts will be made to contact potential winners at the e-mail address provided. If the potential winner cannot be contacted within two (2) days, he/she is no longer eligible to win a Prize in this Contest. No communication will be entered into except with the selected entrants. PRIZE CLAIM CONDITIONS    In order to be declared a winner, a selected entrant must correctly answer, unaided whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered at a mutually convenient time over the telephone with Sponsor or its representative. There will be only one (1) opportunity to answer the mathematical skill-testing question. Selected entrants may also be required, in Sponsor’s sole discretion, to sign and return to Sponsor, within three (3) business days of it being sent by Sponsor, a written declaration and release form, releasing the Sponsor and the Contest Parties from any liability in connection with this Contest or the use, misuse, awarding or possession of any prize and confirms compliance with the Contest Rules (the “Release”).  Selected entrants who are below the age of majority may be required to have their parent/legal guardian ratify their release. If a potential winner cannot be contacted within the specified time, is unable to correctly answer the skill-testing question, otherwise fails to comply with these Contest Rules, fails to sign and return a Release (if applicable) or if any prize or prize notification is returned as undeliverable, Sponsor shall have the right to disqualify that entrant and to randomly draw another eligible entry in accordance with these Contest Rules. By entering, you agree that if the selected entrant is disqualified and the prize is forfeited for any reason, the Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.  The odds of winning depend on the number of eligible entries received during the Overall Contest Period.       GENERAL RULES    All entries become the property of the Sponsor and none shall be returned.  All decisions regarding this Contest and the selection of the winners remain with the Sponsor and its promotional agencies and are final.   No Prize substitutions will be made, except for the right of the Sponsor to make a Prize substitution of equivalent or greater value in the event a Prize is unavailable for reasons beyond the Sponsor’s control. The Prizes must be accepted as awarded and may not be substituted or transferred, except at Sponsor’s sole discretion. Any other costs or expenses associated with the Prize not specified herein will be the responsibility of the selected winner.    The Contest Parties are not responsible for printing, distribution or production errors.  LIMITATION OF LIABILITY AND RELEASE:  UNLESS PROHIBITED BY LAW, BY PARTICIPATING IN THIS CONTEST, THE ENTRANTS AGREE TO RELEASE, DISCHARGE, INDEMNIFY, AND HOLD HARMLESS THE SPONSOR, CONTEST PARTIES, CIBC, FACEBOOK, TWITTER AND INSTAGRAM, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND ASSIGNS FROM AND AGAINST ANY AND ALL CLAIMS AND LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES)TO PERSONS OR PROPERTY ARISING OUT OF OR IN ANY WAY CONNECTED WITH ENTRANT’S PARTICIPATION IN THE CONTEST, THE OPERATION OF THIS CONTEST, OR USE/MISUSE OF ANY PRIZE. PRIZE WINNERS ASSUME ALL LIABILITY FOR ANY INJURY OR DAMAGE CAUSED, OR CLAIMED TO BE CAUSED, BY PARTICIPATION IN THIS CONTEST OR USE OR REDEMPTION OF A PRIZE. FURTHER, BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE THAT SPONSOR, CONTEST PARTIES HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM: A) ENTRY OR PARTICIPATION IN THIS CONTEST OR B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR PRIZE DELIVERY.   Without limiting the foregoing, Sponsor, and the Contest Parties shall not be responsible for: (a) any incomplete or inaccurate information that is caused by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of submissions in the Contest; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss or unauthorized access to, or alteration of, entries; (d) illegible, misdirected or late entries; (e) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (f) garbled transmissions or miscommunications; (g) failure of any e-mail to be received by or from Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (h) damage to a user's computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Contest; (i) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or (i) technical, pictorial, typographical or editorial errors or omissions contained herein.  The Sponsor reserves the right to disqualify any individual that it finds to be violating these official Contest Rules, tampering with the entry process or tampering with the operation of any Contest related website. The Sponsor reserves the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter. Any attempt by anyone to deliberately alter or damage any Contest related website and/or to undermine the legitimate operation of this Contest is in violation of criminal and civil laws and the Sponsor reserves the right to seek damages or other legal remedy to the fullest extent permitted by law.   Winning a prize is contingent on fulfilling all the requirements set forth herein. Mass entries, automated entries, entries submitted by third parties, and any entries or prize claims that are late, incomplete, fraudulent, illegible, unidentified or delayed will be void. All entries and prize claims are subject to verification. Proof of entry submission does not constitute proof of receipt.   Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. Sponsor's failure to enforce any term of these official Contest Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these official Contest Rules shall not affect the validity or enforceability of any other provision. If any provision of the official Contest Rules is determined to be invalid or otherwise unenforceable, then the official Contest Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.  This Contest and the terms and conditions contained in these official Contest Rules, shall be exclusively governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. Any dispute arising hereunder shall be adjudicated solely in the applicable court in Toronto, Ontario, Canada.   Pizza Pizza is not a sponsor nor are they affiliated with this contest. Pizza 73 is not a sponsor nor are they affiliated with this contest.     PRIVACY    Entrants hereby agree and consent to the collection of his/her personal information for the purposes of administrating this Contest and prize fulfillment unless the entrant has lawfully consented to the use of their personal information for other purposes listed at the time of consent, as permitted by the Personal Information Protection and Electronics Documents Act and other applicable legislation. Prize Winners’ information shall be disclosed to the Sponsor specifically the Prize Winner’s name, mailing address, telephone number and/or e-mail address, as this information is required to award a Prize in this Contest. For more details on Sponsor’s privacy practices, visit https://www.spccard.ca/privacy.   Where applicable, this Contest is subject to all federal, provincial and municipal laws.   This Contest is not sponsored, endorsed or administered by Facebook, Twitter or Instagram.  Legal Residents of Quebec Only   Any litigation respecting theconduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
